The Government of Maharashtra recently introduced an amendment to the Right of Children to Free and Compulsory Education Act, 2009, on May 29, which was aimed at enhancing the educational system in the state further.
Previously, the Right to Education Act stated that although students must be evaluated and their educational progress must be improved, schools were obligated to promote students from Standard. 1 to 8.
With the new amendment, significant changes to the Act have been implemented. Let's delve into the key provisions of this amendment and explore its details.
The new amendment, also known as the Maharashtra Right of Children to Free and Compulsory Education (Amendment) Rules of 2023, brings about changes to the rules governing the admission, examination, and promotion of students to the next standard. The following are the key provisions of the Act:

The amendment emphasises the importance of regular assessment through annual examinations. Under the new rule, there will be annual examinations at the end of the Academic year for the Standard 5 and 8. The State Council of Educational Research and Training, Maharashtra (Academic Authority), will be responsible for determining the format and procedure of these examinations, including re-examinations and evaluations. This standardised approach to assessment aims to maintain consistency and fairness in evaluating students' progress and achievements.
In case a student fails to pass the annual examination, the amendment mandates the provision of additional supplementary guidance for the respective subjects. The students who do not succeed in the first examination will be re-examined within two months of the declaration of the results. This shows the commitment of the education system to support struggling students. The aim is to provide students with an opportunity to improve their understanding and skills.
It's all about building a strong foundation and making sure nobody gets left behind. To ensure that no child's education is disrupted prematurely, the amendment introduces the concept of retention. So, if you fail the re-examination after receiving supplementary guidance, then you will be held back in the same Standard (5 or 8) instead of being promoted to the next Standard. Additionally, the amendment explicitly states that no child shall be expelled from school until the completion of elementary education, reinforcing the principle of inclusivity and creating a supportive environment for all learners.
